Giving out a phone number is no longer so simple. Especially if you are a trader or service provider. In fact, due to the entry into force of the DL 59/2021will be obliged to comply with the new rules on the provision and disclosure of telephone lines for consumer contact.
Rules for disclosing contact numbers
Among the rules to be taken into account are that the number (or numbers) must necessarily appear clearly in commercial communications or on the home page of the respective website, or blog. In addition, your number (or numbers) will have to appear clearly and visibly in written communications and in written contracts concluded with the consumer. In other words, the number has to be big and (almost) everywhere.
However, the rules don’t stop there. In fact, you also have to mention the price of the calls. What’s more, if you have several numbers, you’ll have to present them in ascending order of cost.
So that leaves one question: how do you find out the price of calls? There is a solution to this – on geographic lines with numbers beginning with 2 you should write “call to national fixed network” and on those beginning with 9 you should read “call to national mobile network”.
As for the numbers beginning with 707 and 808, they will become an endangered species. After all, it will no longer be beneficial to use them. In fact, these numbers will have to be given greater prominence and the service will be no more efficient than that provided on free or standard rate lines.
And speaking of free lines, you should know that a company providing essential public services will be obliged to provide consumers with a free line on either the fixed or mobile network.
In addition, public bodies with special numbers will now offer an alternative number beginning with 2.
What happens to those who don’t comply?
We weren’t kidding when we talked about added value. In fact, anyone who doesn’t comply with these rules could have to pay between €650 and €60,000! In other words, the amounts corresponding to fines for serious or very serious administrative offenses. The list is below:
i) In the case of a natural person, from € 650.00 to € 1,500.00;
ii) In the case of a micro-enterprise, from € 1,700.00 to € 3,000.00;
iii) In the case of a small business, from € 4,000.00 to € 8,000.00;
iv) In the case of a medium-sized company, from € 8,000.00 to € 16,000.00;
- Very serious offense
i) In the case of a natural person, from € 2,000.00 to € 7,500.00;
ii) In the case of a micro-enterprise, from € 3,000.00 to € 11,500.00;
iii) In the case of a small business, from € 8,000.00 to € 30,000.00;
iv) In the case of a medium-sized company, from € 16,000.00 to € 60,000.00;
